The necked conspiracy hatched in Juba and covered with a thin clothe of law to intimidate the members of SPLM-DC in SSLA is a futile attempt by some persons to twist the law. The legislative arm of the ruling organs in a law abiding state usually supervises the executive branch of the government and not vice versa.
What seems to have occurred in Juba, a cascade of influences initiated by the SG of SPLM who had promised to punish SPLM-DC to gather with commissioner of Panyikango on SSTV. The influence mounted on the caretaker minister of interior who wrote to the caretaker of ministry of legal Affairs and constitutional development to patch up a legal reason for victimizing the SPLM-DC. In his letter, H.E. caretaker minister of interior Major Gen. Gier Chuang to H.E. Michael Makuai asking for what he titled quote “ legal advice on measures to take against SPLM-DC”(24/5/2010). “
It is alleged that SPLM-DC is behind the incident and a case has been opened in Malakal against SPLM-DC members” “the name of plan executer is 2nd Lt. Oriny who is commanding the forces in Obay area” unquote. The caretaker minister of Legal Affairs responded immediately the second day(25/5/2010) by writing to the speaker of SSLA. The D/speaker of SSLA was asked the same day to table the motion in the August house. (25/5/2010). The letter passed to the clerk to table the request the following day(26/5/2010). It is quite clear that this conspiracy had been planned and executed in spite of the fact the executor Lt. Oriny mentioned in the correspondence, who was not caught. This, read in commotion raised by Hon. Henry Omay Akolawin who made it to the parliament on the SPLM party list after wide spread rigging in the state when he abused and told Hon. Onyoti Adigo Nyikwec of SPLM-DC who won the constituency in northern shilluk in an argument that “you will not stay long in the parliament, we will chase you out” Hon. Henry Omay told Onyoti.
This case in spite of its illegality, raises a lot theories.
1. This is not the only killing that took place in the south to acquire a prompt attention of both ministers whose ethnic affiliation is clear read against the background of the Collo un happiness over the grabbed land, thus retaliatory punitive measures are well considered in this conspiracy.
2. First time in five years the two ministries would take great interest as if no police officers were killed in Yambio whose fate are not known till to day.
3. Patients who were killed on hospital beds in Bor no investigations were conducted.
4. Recent killing of intelligence officer in Bor nothing had been done about it. So many incidents went noticed in the south, Why much dust on this one? SSLA instead of being forced to take actions with cooked background out side the Assembly, it should have summoned the two ministers to answer the security laxity, and the lack of law all over the land.
But what did the SSLA do over the starvation eminence in the south? One will not be surprised that most of the deputies who came to SSLA were on rigged votes by the SPLM, and are not expected to offer more than being rubber stamp to endorse the political directives from influential politicians as the SG. It is very clear that these illegal procedures shall be over ruled by the court of constitutional law. However, this case as it stands, is politicized than it being a legal action and carries no credibility.
What SSLA seems not to have given a considerable thought, is the fact that the accusation that the crime was committed by SPML-DC members is vague as all the people in Kingdom support SPLM-DC for reasons obvious enough to many people outside the shilluk land. They voted for SPLM-DC to bypass the neocolonialism imposed on them by politicians that burying their heads in the sand and take no interest other than their own. After all the killer of Kwanyireth Peter Oyath had phoned the people trying to investigate and left his phone with them and to locate him. But why victimize innocent. For those of you who hope to caw down the Collo people by force, is a fallacy.
